Been in a Car Accident? Better Do This First!

There’s no doubt that being involved in a car accident can be a very traumatic experience. However, if you’ve been in an accident, the key to ensuring the quickest and most complete recovery possible, with the necessary compensation from your insurance company, is seeking a proper health assessment and obtaining proper legal advice – specifically in that order – immediately following the accident.
Over the years, we’ve helped thousands of people recover from motor vehicle accidents and the fact is that pain, discomfort and other symptoms often do not appear immediately after an accident. Sometimes it takes hours, days or even weeks before symptoms present themselves even though the damage has been done at the time of the accident. However, what many people don’t know is that there are certain deadlines that must be met when it comes to processing an insurance claim – which is why it’s so important to get properly assessed immediately following an accident and prior to seeking legal advice or proceeding with an insurance claim. Here are the key deadlines:

  • You must notify the Insurance Company of an accident within 7 days
  • You must complete and submit your forms for an Accident Benefits claim, within 30 days of receiving them from your Insurance Company
  • You have 2 years from the date of the accident to sue the responsible driver to recover various types of damages (financial compensation)

Of course, it’s best to not get into any discussions with your insurance company regarding the extent of injuries prior to getting properly assessed and prior to speaking with a personal injury lawyer or paralegal regarding your rights and options.
While you might be concerned about getting a health assessment and treatment prior to submitting/resolving your claim, the fact is that Ontario’s standard auto insurance policy provides injured people with a basic level of benefits including income replacement (in case you can’t return to work) and payment for certain medical expenses, regardless of who is at fault for the accident. So, don’t let cost concerns prevent you from getting properly assessed and even beginning treatment.
